\u6839\u636e1920\u5e74 1\u670816\u65e5\u548c1938\u5e743\u670824\u65e5\u7684\u5baa\u62a5\uff0c\u798f\u5efa\u4e49\u5c71\u65e9\u5df2\u88ab\u516c\u5e03\u4fdd\u7559\u4e3a\u798f\u5efa\u65cf\u7fa4\u4e13\u5c5e\u7684\u5893\u5730\u3002\u6cd5\u5b98\u4ece\u5ead\u5ba1\u4e2d\u7684\u8bc1\u636e\u91cc\u660e\u786e\u5730\u9274\u5b9a\u4e70\u5bb6\u7684\u7236\u4eb2\u786e\u5b9e\u4e0d\u662f\u4e00\u540d\u798f\u5efa\u4eba\u3002\u5982\u679c\u6cd5\u5ead\u5141\u8bb8\u4e70\u5bb6\u7684\u7236\u4eb2\u57cb\u846c\u5728\u798f\u5efa\u4e49\u5c71\uff0c\u8fd9\u5c06\u4f1a\u9020\u6210\u4e00\u4e2a\u8fdd\u80cc\u5baa\u62a5\u7684\u5148\u4f8b\u3002\u56e0\u4e3a\u5baa\u62a5\u81f3\u4eca\u4ecd\u7136\u751f\u6548\uff0c\u9ad8\u5ead\u8ba4\u4e3a\u5982\u679c\u8ba9\u975e\u798f\u5efa\u7c4d\u8d2f\u7684\u5df2\u6545\u8005\u5b89\u846c\u5728\u798f\u5efa\u4e49\u5c71\u662f\u975e\u5e38\u654f\u611f\u7684\uff0c \u56e0\u6b64\u4e0d\u8be5\u8d38\u7136\u8fdd\u4f8b\u3002<\/p>\n\n\n\n<p>\uff08\u4e8c\uff09&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u6cd5\u5b98\u4e5f\u4e0d\u8ba4\u540c\u4e70\u5bb6\u7684\u8fa9\u8bf4\uff0c\u5373\u6307\u5893\u5730\u4e70\u5356\u662f\u57fa\u4e8e\u5979\u6bcd\u4eb2\u4e0e\u672c\u4f1a\u524d\u4e49\u5c71\u7ba1\u7406\u59d4\u5458\u4f1a\u4e3b\u4efb\u4e8e2013\u5e74\u6240\u8fbe\u6210\u7684\u53e3\u5934\u534f\u8bae\u3002<\/p>\n\n\n\n<p>\uff08\u4e09\uff09&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u6cd5\u5b98\u5e76\u4e14\u88c1\u5b9a\u672c\u4f1a\u9986\u5f53\u65f6\u63a5\u53d7\u4e70\u5bb6\u6240\u63d0\u5448\u7684\u7533\u8bf7\u8868\u683c\u548c\u4ed8\u989d\uff0c\u662f\u56e0\u4e3a\u76f8\u4fe1\u4e70\u5bb6\u8868\u683c\u4e2d\u6240\u586b\u5177\u7684\u8d44\u6599\uff0c\u4e5f\u5c31\u662f\u5979\u7684\u7236\u6bcd\u90fd\u6765\u81ea\u201c\u798f\u5efa\u5357\u5b89\u201d\u3002\u9ad8\u5ead\u5224\u65ad\u4e70\u5bb6\u662f\u6709\u8d23\u4efb\u5411\u4f1a\u9986\u63d0\u4f9b\u6709\u5173\u7c4d\u8d2f\u7684\u51c6\u786e\u8d44\u6599\uff0c\u4f46\u4f1a\u9986\u88ab\u8bef\u5bfc\u4e86\u76f4\u52302017\u5e749\u670830\u65e5\u624d\u53d1\u89c9\u771f\u76f8\u3002<\/p>\n\n\n\n<p>\u672c\u4f1a\u867d\u7136\u5728\u5ead\u5ba1\u540e\u80dc\u8bc9\uff0c\u4f46\u662f\u4f1a\u9986\u4e3a\u6574\u8d77\u4e8b\u4ef6\u7684\u53d1\u751f\u611f\u5230\u9057\u61be\uff0c\u5e0c\u671b\u4e70\u5bb6\u548c\u5979\u5bb6\u4eba\u80fd\u627e\u5230\u4e00\u4e2a\u5408\u9002\u7684\u5b89\u606f\u5730\u7ed9\u5979\u7684\u7236\u4eb2\u3002\u540c\u65f6\uff0c\u672c\u4f1a\u4ea6\u5411\u5168\u4f53\u4f1a\u5458\u627f\u8bfa\u4f1a\u9986\u5c06\u7ee7\u7eed\u7ef4\u62a4\u5baa\u62a5\uff0c\u5e76\u786e\u4fdd\u5409\u9686\u5761\u798f\u5efa\u4e49\u5c71\u7684\u846c\u5730\u4ec5\u4fdd\u7559\u7ed9\u96ea\u9686\u798f\u5efa\u540c\u4e61\u4e13\u7528\u3002<\/p>\n\n\n\n<p><strong>\u96ea\u5170\u83aa\u66a8\u5409\u9686\u5761\u798f\u5efa\u4f1a\u9986&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; \u542f<\/strong><\/p>\n\n\n\n<p>Date: 07.11.2020<\/p>\n\n\n\n<p>In February 2018, the Selangor and Kuala Lumpur Hokkien Association (the \u201c<strong>Association<\/strong>\u201d) commenced a legal suit at the Kuala Lumpur High Court against a buyer (\u201c<strong>Buyer<\/strong>\u201d) of two gravesite plots at the Jalan Kerayong (Old Airport Road) Kuala Lumpur Hokkien Cemetery managed by the Association (\u201c<strong>Hokkien Cemetery<\/strong>\u201d).<\/p>\n\n\n\n<p>The Association had taken this action in order to deter the persistent intention of the Buyer to bury her late father who was a non-Hokkien within the Hokkien Cemetery. &nbsp;The Association was previously not aware that the Buyer is not of Hokkien descent because the Buyer had earlier declared in the gravesite application forms that her parents were from the Nanan county in the Fujian (Hokkien) province. The Buyer was therefore allowed to purchase the gravesite plots. &nbsp;It was only on 30 September, 2017 after the passing of the Buyer\u2019s father that the Association discovered that the information in the application forms was untrue. &nbsp;The Association then sought to restrain the Buyer from burying her father or her other non-Hokkien family members at the said gravesite plots.&nbsp;<\/p>\n\n\n\n<p>While this case was awaiting trial, an interim injunction was granted to the Association by the High Court on 14 September, 2018, so that the Buyer was for the time being stopped from carrying out the intended burial of her late father at the Hokkien Cemetery until there was a final decision by the High Court.<\/p>\n\n\n\n<p>On 29 September, 2020, the learned High Court Judge allowed the Association\u2019s claim\uff0c granting a permanent injunction to restrain the Buyer or her representatives from burying her late father or any other non-Hokkien deceased persons at the Hokkien Cemetery.<\/p>\n\n\n\n<p>The reasoning of the High Court was as follows:-<\/p>\n\n\n\n<ol type=\"1\"><li>The Hokkien Cemetery has been gazetted via Gazette Notification dated 16 January, 1920 and 24 March, 1938 (\u201c<strong>Gazette<\/strong>\u201d) to be a reserve for the purposes of burying people of the Hokkien descent only.&nbsp; Based on the evidence at trial, the Court was satisfied that the Buyer\u2019s father was not a Hokkien.&nbsp; To allow the burial of the Buyer\u2019s father at the Hokkien Cemetery would therefore be setting a precedent that is contrary to the Gazette.&nbsp; As the Gazette is still in force, the High Court considered this a very sensitive matter that should not to be taken lightly.<\/li><li>The Court also rejected the Buyer\u2019s defence that she purchased the gravesite plots based on an oral agreement between her mother and the previous Head of the Cemetery Management Committee of the Association in 2013.<\/li><li>The Court further held that the Association had accepted the Buyer\u2019s application forms and the purchase price, for it had relied on the Buyer\u2019s declaration therein that her parents were both from Nanan county in the Fujian Province. &nbsp;The Court&nbsp; found that the burden was on the Buyer to provide accurate information on her ethnic descent to the Association, but the Association was misled about this until the truth came to light around 30 September, 2017.<\/li><\/ol>\n\n\n\n<p>Notwithstanding the outcome in the court proceedings for the Association, we regret that such an incident had taken place and hope that the Buyer and her family would find a suitable resting place for her late father.
